This Company Never Recalled Their Strollers

by | Apr 26, 2019 | Product Liability

We know that you do everything you can to keep your family safe, especially your young children. That is why this recent case, as reported by the Washington Post, is so shocking to us. They have reported that a three-wheeled stroller made by Britax was never recalled, despite hundreds of injuries reported and a lawsuit by the Consumer Product Safety Commission (CPSC).

At Mayer & Rosenberg, P.C., we want to help if you or a loved one have been injured or become ill due to a defective product. Our qualified and experienced team will work to secure the compensation you deserve. When you need a product liability lawyer Kansas City, call us today.

What Happened Here?

The CPSC has received hundreds of consumer-submitted reports of failure for Britax’s BOB stroller. Most of the complaints revolve around a problem with the front wheel coming spontaneously detached. Some of the injuries due to this failure have been severe for both parents and children.

“The danger that was there was just so obvious,” said Marietta Robinson, a former member on the CPSC.

Britax refused the agency’s 2017 request to issues a voluntary recall. As a result, the CPSC filed a lawsuit against them in early 2018 to force a recall. The company fought the lawsuit until the leadership at the CPSC changed. When that happened, the lawsuit was dropped and a recall was never issued.

Instead, Britax was asked to put out an instructional video about safety for the wheel and they offered discounts on new strollers or parts for those affected.

Recall Reality

If we go to the government website tasked with keeping track of all current recalls, we see there are hundreds of products that span nearly every industry. It is always a good idea to keep track of what products you may have that could cause you or your family harm.

Faulty products happen in a few ways:

  • They have a flawed design that makes it through inspections.
  • They experience a manufacturing error that alters them from their original design.
  • They are incorrectly labeled, misleading consumers about hazards, instructions, dosages, ingredients, etc.

Unfortunately, not all faulty products are on that list, as evidenced by the story above. There are also times with a product’s flaws are not discovered until years after it has hit the market and already potentially in hundreds of thousands of homes.

Moving On Now

The safety of our families is number one. When a company, or even a government agency, betray our trust and allows a faulty product to hit the market, they should be held accountable. At Mayer & Rosenberg, P.C., we will work to investigate your case so we can secure compensation for all of your incident-related expenses, including:

  • Coverage of medical expenses
  • Recovery of lost wages if you cannot work
  • Pain and suffering damages
  • Loss of enjoyment of life damages
  • Punitive damages against the company or manufacturer
